DRAFT PENDING LEGAL REVIEW — version v1. This wording has not been reviewed by a lawyer. It is published so the product can record what you were actually shown. When it is reviewed, the revised wording becomes version v2 and is stored as a new version; this one is never edited, so the exact text you agreed to can always be produced.
1. What The Hiring Record is
The Hiring Record watches job postings over time and reports what it observed. We check applicant tracking systems every day, record which postings exist, and record the moment each one disappears. Alongside that we collect public records about employers: layoff notices filed with state WARN programmes, workforce reductions reported to the SEC on Form 8-K, retirement-plan filings (Form 5500), federal bankruptcy dockets, and workplace establishment data published by OSHA.
We use that history to tell you whether a posting looks likely to be worth your time.
2. What we do not do
We do not read job descriptions to judge a posting. Other tools score the wording of an advertisement. We do not: our judgement comes from what happened to a posting over time and from an employer's public filings. We keep the structured details of a posting — title, location, dates, compensation where stated — and a fingerprint of its text. We do not publish the body of any posting.
We never state what an employer intended. We do not describe any employer as posting a "ghost job". We report what we observed and what public records say. Any recommendation is addressed to you, about how to spend your effort, and is never a claim about a company's motives.
We suppress rather than guess. Where we have too little evidence, we say so and show no number. An absence of data is reported as an absence of data.
3. Accounts
You do not need an account to check a posting. An account becomes useful when you want your checks saved across devices, your applications tracked, or alerts delivered.
You are responsible for what happens under your account. Tell us promptly at [CONTACT ADDRESS] if you believe someone else has access to it.
4. Paid products
Job Search — $79, one payment, 90 days of access. Matching and search features for ninety days from purchase. It does not renew.
Career Watch — $9 per month. Ongoing monitoring of employers you choose to watch, with alerts when something is filed. It renews monthly until you cancel, and you can cancel at any time; cancelling stops the next renewal and leaves access in place for the period already paid for.
Prices are in US dollars and exclude any tax we are required to collect. Refunds: [REFUND TERMS TO BE SET BY LEGAL REVIEW].
5. What we do not promise
We do not promise you a job, an interview, or a reply. We do not promise that any posting is real, that any employer will behave in any particular way, or that our record is complete. Our record begins when we started watching; a posting that already existed at that moment has a start date we cannot know, and we mark it as such rather than estimating one.
We may be wrong. If you think we are, our corrections process is open to anyone, and any employer may publish a reply on their own record at no cost.
6. Using the service
Do not resell, redistribute, or systematically extract our records. Do not use the service to harass any person or company. Do not attempt to identify individual applicants from anything we publish; we do not name individuals, and attempting to re-identify them is a misuse of the service.
7. Reports from applicants
If you submit a report about an application, it is submitted anonymously and is combined with other reports. Once your report has been aggregated it cannot be individually withdrawn, because it no longer exists as a separate record. Please do not submit anything you would not want published in aggregate form.
8. Ending your account
You can delete your account at any time. Deletion removes your identity, your tracked applications, and your account data.
Deletion does not remove statistics already computed from your activity, and does not withdraw reports you have submitted, for the reason given in section 7. This is stated here rather than discovered later.
9. Changes
If we change these terms we will publish the new version and ask you to accept it. The version you accepted remains retrievable.
10. Contact and law
The Hiring Record is operated by [LEGAL ENTITY], [ADDRESS]. Questions: [CONTACT ADDRESS]. Governing law and venue: [TO BE SET BY LEGAL REVIEW].
This is the version currently in effect. Each version is stored separately and is never edited, so the exact wording anybody agreed to can be produced. Corrections to the record itself are published at hiringrecord.com/corrections.
